Alex's Ex-wife Sued Over Use of Van Halen Name

Van Halen is taking legal action against Kelly Van Halen, ex-wife of drummer Alex Van Halen, for trademark infringement, according to an exclusive report filed by The Hollywood Reporter on Wednesday.

Alex Van Halen was married to his second wife Kelly Carter for twelve years beginning in 1984 and divorced in 1996. The band's intellectual property holding company ELVH, filed a lawsuit in California federal court and is reportedly objecting to Kelly's filing of two trademark applications for the use of "Kelly Van Halen" - her real name - for use in business.

According to the report, she has used the name for her construction and interior design company, which ELVH claims is an infringement of their trademark.

Isn't that a little heavy-handed?  Suing someone for trying to trademark her own name?  But Van Halen is managed by Irving Azoff who also manages Joe Walsh and The Eagles and is infamously ruthless when it comes to protecting his brands.

Read the Hollywood Reporter story for more details, including some details about a previous Supreme Court ruling which may affect this case.
