A label claims that Metallica ripped off a song from its catalog for “Moth Into Flame” from Hardwired…to Self Destruct.

Exclaim reports that Brutal Records sent a cease-and-desist letter last month, saying “Moth Into Flame” is “fundamentally a close duplication” of “Hunger for Power,” a track released in 1988 by the death metal band Incubus.

And no, it’s not the same Incubus. After the band that gave us “Drive” and “I Wish You Were Here” secured the copyright for the name in the late ’90s, the death metal Incubus changed its name to Opprobrium. And in 2016, Brutal Records reissued the album that contains “Hunger for Power,” Serpent Temptation, under the Opprobrium name last year.

The letter says failure to comply will lead to “a civil action suit seeking monetary damages.” Metallica have yet to publicly respond.
